Felony Classification in Scottsdale

In the state of Arizona, felonies are classified by number. The lower the number classification, the worse the offense is. Presumptive sentencing and punishments for first time felony offenders is as follows:

  • Class 6 Felony - .5 to 1.5 years in jail and/or fines of no less than $750; Probation eligible
  • Class 5 Felony - .75 to 2 years in jail and/or fines of no less than $750; Probation eligible
  • Class 4 Felony - 1.5 to 3 years in jail and/or fines of no less than $750; Probation eligible
  • Class 3 Felony - 2.5 to 7 years in jail and/or fines of no less than $750; Probation eligible
  • Class 2 Felony – 4 to 10 years in jail and/or fines of no less than $750; Probation eligible

For repeat offenders, the sentence is proportional to the charge along with the alleged offender’s prior history, and the alleged offender will most likely not be eligible for probation. In fact, Arizona does impose “Mandatory Sentencing” laws for felony charges. These laws can come into effect in the following circumstances:
